Alleinauftrag

Ein Alleinauftrag ist eine Vereinbarung zwischen einem ImmobilienverkĂ€ufer (Auftraggeber) und einem Immobilienmakler, die dem Makler das exklusive Recht einrĂ€umt, eine Immobilie zu vermarkten und KĂ€ufer oder Mieter dafĂŒr zu akquirieren. WĂ€hrend der Laufzeit des Alleinauftrags darf der VerkĂ€ufer keinen weiteren Makler beauftrage

Anlageimmobilie

Anlageimmobilien sind Immobilien, die von dem EigentĂŒmer nicht selbst genutzt werden und als Geldanlage dienen. Aufgrund der Vermietung sorgen diese Kapitalanlagen fĂŒr regelmĂ€ĂŸiges Einkommen. Hierbei kann es sich um Gewerbe- oder Wohnimmobilien handeln.

Auftrag

Ein Maklerauftrag ist ein Vertrag zwischen einem Auftraggeber (z. B. EigentĂŒmer) und einem Makler, bei dem der Makler beauftragt wird, eine Immobilie zu vermitteln, sei es durch Verkauf oder Vermietung. Der Makler erhĂ€lt bei erfolgreicher Vermittlung eine vereinbarte Provision.

Baubeschreibung

Baubeschreibung Eine Baubeschreibung umfasst die detaillierte Aufstellung ĂŒber alle Ausstattungs- und Ausfertigungsmerkmale eines Bauvorhabens. Wichtige Inhalte der Baubeschreibung sind zum Beispiel die Beschaffenheit der WĂ€nde und des Daches, die Heizung, die Art der Fenster etc. Außerdem gibt sie genaue Auskunft ĂŒber die beim Bau verwendeten Materialien.

BaugrundstĂŒck

Ein BaugrundstĂŒck ist ein GrundstĂŒck, auf dem der EigentĂŒmer die Erlaubnis zum Bauen besitzt. Voraussetzung fĂŒr die Errichtung von GebĂ€uden ist die Baugenehmigung, die fĂŒr das GrundstĂŒck vorliegen muss.

BautrÀger

BautrĂ€ger ist ein Unternehmen, welches in der Regel GrundstĂŒcke, oder Abrissobjekte kauft. Diese dann neu ĂŒberplant, schlĂŒsselfertig bebaut und weiter zum Verkauf anbietet

BruttoflÀche

Die BruttoflĂ€che der Wohnung bezeichnet die gesamte begehbare FlĂ€che einer Wohnung, einschließlich der Dicke der AußenwĂ€nde (vollstĂ€ndige MauerstĂ€rke) sowie der HĂ€lfte der Dicke der TrennwĂ€nde zwischen den Wohnungen. Sie umfasst somit die NettowohnflĂ€che zuzĂŒglich der WandflĂ€chen.

Besitz

Der Besitz beschreibt die tatsĂ€chliche Herrschaft ĂŒber eine Sache, wie z. B. eine Immobilie, unabhĂ€ngig davon, ob die Person auch rechtlicher EigentĂŒmer ist. Der Besitzer nutzt oder verwaltet die Immobilie, ohne notwendigerweise die Eigentumsrechte zu besitzen. Besitz und Eigentum können getrennt sein, z. B. bei einem Mieter, der im Besitz der Immobilie ist, aber nicht deren EigentĂŒmer. Der Besitz ist im Art. 1140 des italienischen ZGB. geregelt

BĂŒrgschaft

Eine BĂŒrgschaft im Immobilienkontext ist eine vertragliche Vereinbarung, bei der eine Person (BĂŒrge) sich verpflichtet, fĂŒr die Verbindlichkeiten eines anderen (Schuldner) gegenĂŒber einem GlĂ€ubiger einzutreten, falls dieser seine Zahlungsverpflichtungen nicht erfĂŒllt. In der Immobilienbranche wird eine BĂŒrgschaft hĂ€ufig bei MietverhĂ€ltnissen oder Baufinanzierungen genutzt, um das Risiko des GlĂ€ubigers zu minimieren. Der BĂŒrge ĂŒbernimmt die Verantwortung, die Schulden zu begleichen, wenn der Hauptschuldner zahlungsunfĂ€hig wird.

C
Cedolare Secca

Die Cedolare Secca ist die sogenannte Ersatzsteuer auf Mieteinnahmen, d.h. der Vermieter zahlt anstelle der Einkommenssteuer Irpef eine Abgeltungssteuer in Höhe von 21% auf die Jahresmiete bei freien MietvertrÀgen (10% auf die Jahresmiete bei MietvertrÀgen mit vereinbarten Mietzins in Gemeinden mit Wohnungsnot).

Vorteile: keine Register- und StempelgebĂŒhren; die Miete wird nicht zum Gesamteinkommen gezĂ€hlt

Nachteile: die Miete darf fĂŒr die Dauer der Option nicht erhöht werden und gilt momentan nur fĂŒr MietvertrĂ€ge zu Wohnzwecken

Diese Art von Besteuerung gilt fĂŒr die gesamte Laufzeit des Mietvertrages, kann jedoch vom Vermieter widerrufen werden.

Denkmalschutz

Der Denkmalschutz beschreibt die Bewahrung und Instandhaltung von Objekten der Kunst, Geschichte oder Natur, an denen ein öffentliches Interesse besteht. Immobilien, die unter Denkmalschutz stehen, mĂŒssen verschiedene Auflagen umsetzen und befolgen, um die UrsprĂŒnglichkeit des GebĂ€udes zu bewahren.

Dienstbarkeit

Eine Dienstbarkeit ist ein dingliches Recht, das dem Berechtigten ein bestimmtes Nutzungsrecht an einem fremden GrundstĂŒck einrĂ€umt, wie zum Beispiel ein Wegerecht, ein Leitungsrecht oder ein Überbaurecht. Die Dienstbarkeit belastet das dienende GrundstĂŒck zugunsten des herrschenden GrundstĂŒcks und ist im Grundbuch eingetragen.

Eigentum

Das uneingeschrĂ€nkte Recht einer Person oder Institution, ĂŒber eine Sache oder ein Objekt, wie beispielsweise eine Immobilie, zu verfĂŒgen. Eigentum beinhaltet die Befugnis, das Objekt zu nutzen, es zu vermieten, zu verĂ€ußern oder zu belasten. Der EigentĂŒmer wird im Grundbuch eingetragen und kann seine Rechte im Rahmen der gesetzlichen Vorschriften ausĂŒben. Eigentum ist im Art. 832 des italienischen ZGB geregelt.

Erstwohnung - Zweitwohnung

Erstwohnung: Darunter versteht man die Wohnung, in der gewĂ€hlten Wohnsitzgemeinde, welche erstrangig zum Wohnen verwendet wird. Beim Erwerb der Erstwohnung kommen verschiedene SteuerbegĂŒnstigungen zur Anwendung.Zweitwohnung: Als Zweitwohnung gelten alle Ferienwohnungen aber auch jene Wohnungen, welche von einem KĂ€ufer erworben werden, welcher bereits eine Wohnung besitzt.

Erbschaft

Bei einer Erbschaft handelt es sich um das aktive und passive Vermögen eines Menschen, das nach seinem Tod auf einen oder mehrere Erben rechtlich ĂŒbertragen wird. Innerhalb von sechs Wochen kann dieses Erbe angenommen oder ausgeschlagen werden.

Energieausweis

Der KlimaHaus Energieausweis ist ein Bedarfsausweis, das heißt es werden der PrimĂ€r- und der Endenergiebedarf ausgewiesen. Der Energiebedarf eines GebĂ€udes wird bestimmt ĂŒber die energetische QualitĂ€t der GebĂ€udehĂŒlle und den technischen Anlagen zum Heizen und zur Warmwasserbereitung. In die Berechnung des Energiebedarfs fließen alle energierelevanten Faktoren ein, wie z. B. GebĂ€udevolumen und -flĂ€chen, Bauweise, Material der WĂ€rmedĂ€mmung, Anlagentyp zur Erzeugung von Warmwasser und HeizwĂ€rme.

Finanzierung

Eine Finanzierung beinhaltet alle Prozesse, die fĂŒr eine zuvor festgelegte Investition benötigt werden. Dazu zĂ€hlen Beantragung, Bereitstellung sowie RĂŒckzahlung der zur VerfĂŒgung gestellten Finanzmittel.

Fruchtgenuss

Der Fruchtgenuss ist das umfassendste persönliche Nutzungsrecht an einer Immobilie. Es berechtigt den Inhaber (Fruchtnießer), die Immobilie in vollem Umfang zu nutzen und die "FrĂŒchte" daraus zu ziehen, wie z. B. Mieteinnahmen. Der Fruchtnießer ist jedoch nicht EigentĂŒmer der Immobilie, sondern lediglich Nutzungsberechtigter. Der Fruchtgenuss ist ein dingliches Recht, welches im Grundbuch eingetragen wird und auch nach einem Verkauf der Immobilie weiterhin besteht. Er kann zeitlich befristet oder lebenslang gewĂ€hrt werden. Der Nießbraucher trĂ€gt die laufenden Kosten und Pflichten der Immobilie (z. B. Instandhaltung), wĂ€hrend der EigentĂŒmer fĂŒr grundlegende Belastungen (z. B. Hypotheken) verantwortlich bleibt. Der Fruchtgenuss wird im Art. 987 des ZGB. geregelt

G
Gemeindeimmobiliensteuer Gis

Die Gemeindeimmobiliensteuer wird von EigentĂŒmern oder Inhabern von dinglichen Rechten (Fruchtgenuss-, Nutzungs-, Wohn-, Überbaurecht) an GebĂ€uden, BaugrĂŒnden und landwirtschaftlichen GrundstĂŒcken an die Gemeinde, wo sich die Immobilie befindet, entrichtet. Grundlage fĂŒr deren Errechnung ist der Katasterwert. Der Koeffizient, mit der die Steuer berechnet wird, kann von den Gemeinden selbst bestimmt werden, auch FreibetrĂ€ge bei Erstwohnungen können von der Gemeinde erlassen werden, diese fallen bei einer Zweitwohnung weg, die Steuer ist dann betrĂ€chtlich höher.

Geschlossener Hof

In der Regel handelt es sich um landwirtschaftliche GrundstĂŒcke mit den dazugehörigen landwirtschaftlichen GebĂ€uden. Rechtlich ausschlaggebend ist die Eintragung in der Abteilung I des Grundbuches. Das Höfegesetz bildet den rechtlichen Rahmen fĂŒr die Aufrechterhaltung des geschlossenen Hofes als landwirtschaftliche Wohn- und Wirtschaftseinheit und sichert so den Fortbestand desbĂ€uerlichen Familienbetriebes. Ein „geschlossener Hof“ kann nur als Einheit verĂ€ußert werden. Abtrennung oder gar die Auflösung dieser Einheiten kann von der örtlichen Höfekommission, beim Rekurs, von der Landeshöfekommission. Laut LandwirtschaftszĂ€hlung gibt es in SĂŒdtirol ca. 20.200 landwirtschaftliche Betriebe, davon sind ungefĂ€hr 13.300 geschlossene Höfe.

Grundbuch

Beim Grundbuch handelt es sich um ein amtlich, öffentliches Verzeichnisse von Immobilien, in denen die EigentumsverhĂ€ltnisse durch die Eintragung der entsprechenden VertrĂ€ge (Kauf/Verkauf, Schenkung, Tausch, etc.) sowie etwaige mit dem GrundstĂŒck verbundene Rechte und auf ihm liegende Lasten (Dienstbarkeiten, Hypotheken, Sicherstellungen, PfĂ€ndungen, usw.) erfasst werden. In diesem Register kann jeder frei Einsicht nehmen. Ein Grundbuch gibt es nur in SĂŒdtirol – d.h in der autonomen Provinz Bozen und in der Provinz Trient, sowie in den alt-österreichischen Provinzen wie Triest und Görz-Gorizia und in einigen Gemeinden im Belluno, im Rest von Italien nicht. Das Grundbuch verfolgt hauptsĂ€chlich die EigentĂŒmer und aktive und passive Rechte sowie Belastungen, das Kataster, die Ausmaße und die FlĂ€chenverĂ€nderungen der Liegenschaften.

H
Hypothek

Die Hypothek gibt dem GlÀubiger das Recht, aus einer Liegenschaft oder einer in öffentliche Register eingetragenen beweglichen Sache durch öffentliche Versteigerung, die Deckung zu erlangen, wenn der Schuldnerseiner Forderung nicht rechtzeitig nachkommt.

Es gibt die gesetzliche Hypothek (z.B. zugunsten eines Erben zur Sicherung von AnsprĂŒchen), die gerichtliche Hypothek (zur Sicherung eines Schuldtitels), oder die freiwillige Hypothek (z.B. bei einem Bankkredit, mussnotariell beurkundet und im Grundbuch eingetragen werden).

Kataster

Der Kataster ist ein von der Behörde gefĂŒhrtes Register, in dem sĂ€mtliche Immobilien Italiens erfasst sind, geordnet nach Gemeinden, mit den entsprechenden MappenblĂ€ttern, GrundstĂŒcksnummern und Baueinheiten, sowie den anderen Angaben, welche fĂŒr die Berechnung des Einheitswerts (Katasterwert) notwendig sind. Der Einheitswert dient als Basis fĂŒr die Berechnung der Steuern. Dieses Register hat eine rein steuerliche Funktion und hat keine Beweiskraft ĂŒber die EigentumsverhĂ€ltnisse, auch wenn die Namen der EigentĂŒmer darin vermerkt sind.

Katasterwert

Dabei handelt es sich um den steuerlichen Wert einer Liegenschaft, welcher zur Berechnung von Steuern und Abgaben herangezogen wird.

‍

Katasterklassen

Anhand der Qualifikation kann bestimmt werden, in welche Kategorie eine Immobilie fĂ€llt. Immobilien fĂŒr Wohnzwecke oder fĂŒr gewerbliche Nutzung usw. sind zum Beispiel in ganz Italien gĂŒltige Kategoriebezeichnungen.

‍

Innerhalb dieser Kategorien existieren verschiedene Klassen, d. h. innerhalb einer Kategorie werden weitere Unterscheidungen vorgenommen, gemĂ€ĂŸ den jeweils möglichen ErtrĂ€gen.

‍

Derzeit existieren die folgenden sieben Gruppen:

Gruppe A – Wohnimmobilien und BĂŒrorĂ€ume (Abitazioni e uffici)
Gruppe B – Immobilien fĂŒr Dienstleistungszwecke (Immobili destinati a servizi)
Gruppe C – Gewerbeimmobilien (Immobili commerciali)
Gruppe D – Immobilien fĂŒr besondere Zwecke (Immobili a destinazione speciale)
Gruppe E – Immobilien fĂŒr private Zwecke (Immobili a destinazione particolare)
Gruppe F – StĂ€dtische Immobilieneinheiten (EntitĂ  urbane)
Gruppe T – GrundstĂŒcke (Terreni)

Kaufvertrag

Ein Kaufvertrag ist ein rechtliches Abkommen zwischen zwei Parteien, dem VerkĂ€ufer und dem KĂ€ufer, bei dem sich der VerkĂ€ufer verpflichtet, das Eigentum an einer Sache, z. B. einer Immobilie, an den KĂ€ufer zu ĂŒbertragen, und der KĂ€ufer sich im Gegenzug verpflichtet, den vereinbarten Kaufpreis zu zahlen.

‍

Der Vertrag regelt die Bedingungen der Transaktion, darunter:

  • IdentitĂ€t der Vertragsparteien (VerkĂ€ufer und KĂ€ufer),
  • Beschreibung des Kaufgegenstands,
  • Kaufpreis und ZahlungsmodalitĂ€ten,
  • Gegenseitige Pflichten.

Bei Immobilien muss der Kaufvertrag schriftlich abgefasst und in der Regel von einem Notar beglaubigt werden. Der Kaufvertrag wird im italienischen ZGB Art. 1470 definiert.

Kaufvorvertrag

Ein Vorvertrag ist jene schriftliche Vereinbarung zwischen KÀufer und VerkÀufer, mit welcher sich die Vertragsparteien zu einem KaufgeschÀft verpflichten den Kaufpreis und die Zahlungsbedingungen und dessen grundsÀtzliche Fristen und Abmachungen vereinbaren.

Klimahaus

Das Klimahaus ist ein GebĂ€ude, welches nach bestimmten Standards fĂŒr Energieeffizienz, Nachhaltigkeit und Umweltfreundlichkeit errichtet oder saniert wurde. Es zielt darauf ab, den Energieverbrauch zu minimieren und einen hohen Wohnkomfort zu gewĂ€hrleisten. Die Zertifizierung erfolgt durch das KlimaHaus-Agentur System und umfasst verschiedene Kategorien wie KlimaHaus A, B oder Gold.

KonventionalflÀche

Es handelt sich um die WohnflĂ€che, die von der Wohnbauförderung gesetzlich anerkannt ist. Die KonventionalflĂ€che setzt sich wie folgt zusammen (Berechnung lt. Autonomer Provinz BZ-SĂŒdtirol):

die um 25% erhöhte WohnflÀche einer Wohnung, 25% der BalkonflÀche, 50% der FlÀchen von Loggien oder der WintergÀrten, 30% der KellerflÀchen, 60% der FlÀchen der Garagen, 30% der FlÀchen der offenen AbstellplÀtze, 25% der LaubengÀnge im Erdgeschoss, 15% der TerrassenflÀchen, 30% der DachbodenflÀche (mind. 1,5 m Höhe).

Konventionierung

Der Begriff „Konventionierung“ bedeutet, dass die Wohnung nur von Personen bewohnt werden darf, welche die Voraussetzung dazu haben. Voraussetzungen sind eine mindestens fĂŒnfjĂ€hrige AnsĂ€ssigkeit in der Provinz oder eine Arbeit in der Gemeinde, in der sich die Wohnung befindet . Der Erwerb einer solchen Immobilie ist jedem frei, laut Artikel 79 des Landesraumordnungsgesetz von 1997, muss aber als Eigenbedarf besetzt werden oder muss zu einem berechneten „Landesmietzinspreis“ als Erstwohnung an jemanden, der die oben genannten Kriterien erfĂŒllt, vermietet werden

‍

Kubatur

Als urbanistische Kubatur wird das GebĂ€udevolumen außer Boden bezeichnet. Das zu verbaubare Bauvolumen auf einer GrundstĂŒcksflĂ€che errechnet man mit dem Bauindex, welcher lt. geltenden Bauleitplan fĂŒr die betreffende Bauzone vorgesehen ist, bzw. aus den DurchfĂŒhrungsbestimmungen fĂŒr die betreffende Zone.

M
Makler

Makler ist, wer professionell zwei oder mehrere Parteien, lt. den Artikel 1754 zu einem GeschĂ€ftsabschluss zusammenbringt. und Art. 1755 des ZGB. Art. 1755 bestimmt, dass der Makler Anspruch auf die Provision von jeder Partei hat, wenn das GeschĂ€ft durch sein Zutun zustande gekommen ist. Artikel 6 Gesetz 39/1989 bestimmt diesbezĂŒglich, dass die Provision nur den im Verzeichnis der Makler eingetragenen Makler zusteht. Voraussetzung, um im Verzeichnis der Makler bei der zustĂ€ndigen Handelskammer eingetragen zu sein, ist die Matura, des Besuches eines intensiven Vorbereitungskurs und einer strengen schriftlichen und mĂŒndlichen Kommission die Von der Handelskammer ernannt wird.

Marktwert

Der Marktwert gibt den erzielbaren Preis an, der mit dem Verkauf auf dem Markt erreicht werden kann. Die Ermittlung des Werts erfolgt durch einen Gutachter oder Immobilienexperten.

‍

Mehrwertsteuer (MwSt)

ist eine Steuer, die beim Kauf einer Immobilie anfÀllt, wenn der VerkÀufer ein BautrÀger oder ein Unternehmen aus der Immobilienbranche ist. Die Höhe der Steuer variiert je nach Art der Immobilie:

  • 4 % fĂŒr den Kauf einer Erstwohnung,
  • 10 % fĂŒr Zweitwohnungen,‍
  • 22 % fĂŒr gewerbliche Immobilien oder Wohnungen, die als LuxusgĂŒter eingestuft sind.

Mietkaution

Die Mietkaution ist eine Sicherheitsleistung des Mieters an seinen Vermieter. Sie schĂŒtzt den Vermieter fĂŒr den Fall, dass ein Mieter seinen Zahlungsverpflichtungen nicht nachkommt. Sind beispielsweise nach dem Auszug des Mieters noch Monatsmieten oder Betriebskosten offen oder der Mieter bezahlt SchĂ€den an der Wohnung nicht, dann kann der Vermieter die Kaution zurĂŒckbehalten. Die Mietkaution betrĂ€gt in der Regel 3 Monatsmieten.

N
Nacktes Eigentum

Das Nackte Eigentum bezeichnet das Eigentum an einer Sache ohne das Recht, sie zu nutzen oder daraus ErtrĂ€ge zu ziehen. Es bedeutet, dass man der rechtliche EigentĂŒmer ist, aber jemand anderes das Nutzungsrecht hat - meistens das Fruchtgenussrecht oder den Nießbrauch.

NettowohnflÀche

Diese wird auch als reine WohnflĂ€che bezeichnet und ist die reine begehbare FlĂ€che eines Hauses oder Wohnung. Es wird die effektive WohnflĂ€che von der EingangstĂŒr weg, ohne Mauern, Balkone und Terrassen, gerechnet.

Notar

Der Notar ist ein neutraler, staatlich bestellter Jurist, welcher RechtsgeschĂ€fte beurkundet. Der Notar sorgt dafĂŒr, dass alles rechtlich korrekt und verstĂ€ndlich fĂŒr die Parteien ablĂ€uft und garantiert fĂŒr die ZuverlĂ€ssigkeit der Angaben in öffentlichen Registern wie z.B. Grundbuch.

P
Provision

Die Provision ist das Entgelt des Immobilienmaklers fĂŒr seine VermittlungstĂ€tigkeit. Sie ist bei Abschluss des Kaufvorvertrages, welcher durch die TĂ€tigkeit des Maklers zustande gekommen ist, geschuldet. Die Vereinbarung ĂŒber die Höhe ist frei. Unsere Provision betrĂ€gt 3% + MwSt. des GeschĂ€ftswerts.. Bei Vermietungen sind es eine Monatsmiete von beiden Parteien.Steuer-Tipp: Bei einer Immobilie, die als Erstwohnsitz angemeldet wird, besteht die Möglichkeit, 19% der erklĂ€rten Maklerprovision (max. 1.000 €) von der Steuer abzusetzen.

R
Rendite

Die Rendite ist der Gewinn, welchen man mit einer Geldanlage, in Prozent des eingesetzten Geldes. Sie zeigt das VerhĂ€ltnis zwischen Gewinnen und dem dafĂŒr eingesetzten Kapital, meist prozentual an und ist stets auf ein Jahr bezogen.

Spesen fĂŒr den KĂ€ufer

Der KĂ€ufer ĂŒbernimmt alle Ankaufsspesen, die Spesen des Notars, die Registerspesen, Grundbuch- und Katastereintragung.

Die Spesen fĂŒr den KĂ€ufer werden wie folgt zusammengesetzt:

  • Registersteuer oder Mehrwertsteuer 
  • Kataster- und Hypothekarsteuer
  • Notarkosten
  • Vermittlungsprovision

Spesen fĂŒr den VerkĂ€ufer

Die Spesen fĂŒr den VerkĂ€ufer können je nach Objekt und Haltedauer variieren. Deshalb ist es sinnvoll vor dem Verkauf mit sich bei einem Fachmann zu informieren.

SchÀtzung

Mit einer SchĂ€tzung wird der Wert einer Immobilie ermittelt. Dazu verwenden wir diverse Methoden wie das Vergleichswertverfahren, das Ertragswertverfahren, das Sachwertverfahren oder das DCF-Modell. GeschĂ€tzt werden können nicht nur Immobilien oder GrundstĂŒcke, sondern auch Fruchtgenussrechte oder das Nackte Eigentum.

Schenkung

Eine Schenkung ist eine unentgeltliche Übertragung von Vermögen oder Sachwerten einer Partei zu einer anderen Partei. In diesem Fall erbringt nur der Schenker eine Leistung, die keine Gegenleistung verlangt. Je nach Wert und Summe, können Schenkungen auch steuerpflichtig sein.

Steuern beim Ankauf einer Wohnung

Die VerkaufsflÀche einer Wohnung wird mit folgenden Kriterien berechnet:: es zÀhlen die gesamte WohnflÀche samt allen Mauern, die HÀlfte der angrenzenden Mauern, die HÀlfte der Balkone und Terrasse und ein Drittel vom Keller.

Vertrag

Ein Vertrag ist eine rechtliche Vereinbarung zwischen zwei oder mehr Parteien, bei der wechselseitige Rechte und Pflichten festgelegt werden, um ein legales und gemeinsames Ziel zu erreichen. In Italien werden VertrĂ€ge durch das ZVG Art. 1321 geregelt und mĂŒssen grundlegende Anforderungen wie Zustimmung, Zweck, Gegenstand und gegebenenfalls Formvorschriften erfĂŒllen.

Vorkaufsrecht

Das Vorkaufsrecht bezeichnet das vertraglich oder gesetzlich festgelegte Recht einer Person (Vorkaufsberechtigter), ein GrundstĂŒck, eine Immobilie oder eine Wohnung zu den gleichen Konditionen zu erwerben, die ein Dritter mit dem VerkĂ€ufer vereinbart hat.

Dieses Recht tritt in der Regel dann ein, wenn der VerkÀufer einen Kaufvertrag mit einem Dritten geschlossen hat. Der Vorkaufsberechtigte wird informiert und kann zu einer Frist entscheiden, ob er zu den im Vertrag festgelegten Bedingungen anstelle des Dritten in den Kaufvertrag eintritt.

Wohnrecht

Das Wohnrecht ist das Recht, eine Immobilie oder einen festgelegten Teil davon zu bewohnen. Die Unterhaltskosten zum Erhalt und Betreiben der Immobilie werden jedoch weiterhin vom EigentĂŒmer getragen.

Das Wohnrecht ist ein im Grundbuch eingetragenes Recht, das einer Person das dauerhafte oder zeitlich befristete Nutzungsrecht an einer Immobilie oder einem Teil davon einrĂ€umt, ohne dass diese Person EigentĂŒmer ist. Es ermöglicht dem Berechtigten, die Immobilie zu bewohnen oder fĂŒr Wohnzwecke zu nutzen, jedoch nicht, sie an Dritte zu vermieten.

Das Wohnrecht kann als dingliches Recht im Grundbuch gesichert werden ( ZGB Art 1022) wodurch es auch bei einem Verkauf der Immobilie bestehen bleibt. Es wird hĂ€ufig im Zusammenhang mit Schenkungen oder Übertragungen von Immobilien vereinbart, um den Verbleib des bisherigen EigentĂŒmers in der Immobilie zu sichern.

WohnflÀche

Die WohnflĂ€che gibt die FlĂ€che einer Immobilie an, die ausschließlich zum Wohnen genutzt werden kann. Terrassen und Balkone werden mit bestimmten Koeffizienten gerechnet.

Agente immobiliare

L’agente immobiliare Ăš una persona che professionalmente mette in contatto due o piĂč parti per concludere una transazione, ai sensi degli articoli 1754 e 1755 del Codice civile italiano. L'articolo 1755 stabilisce che l’agente immobiliare ha diritto a una commissione da ciascuna parte se la transazione Ăš stata conclusa grazie al suo intervento. L'articolo 6 della Legge 39/1989 stabilisce a questo proposito che solo gli agenti immobiliari iscritti nel registro degli agenti immobiliari hanno diritto alla commissione. Per essere iscritti nel registro degli agenti immobiliari presso la camera di commercio competente, Ăš necessario avere un diploma di scuola superiore, frequentare un corso intensivo di preparazione e superare un rigoroso esame scritto e orale davanti a una commissione nominata dalla camera di commercio.

CasaClima

‍La CasaClima ù un edificio costruito o ristrutturato secondo specifici standard di efficienza energetica, sostenibilità e rispetto ambientale. L’obiettivo ù quello di ridurre al minimo il consumo energetico e garantire un elevato comfort abitativo. La certificazione avviene attraverso il sistema dell’Agenzia CasaClima e comprende diverse categorie come CasaClima A, B o Gold.

Cedolare Secca

La Cedolare Secca Ăš la cosiddetta imposta sostitutiva sui redditi da locazione, ovvero al posto dell'Irpef il locatore paga un'imposta forfettaria del 21% sul canone annuo per le locazioni libere (10% sul canone annuo per le locazioni a canone concordato nei comuni con carenza abitativa).

Vantaggi: nessuna imposta di registro e di bollo; l'affitto non viene conteggiato nel reddito totale

Svantaggi: il canone di locazione non puĂČ essere aumentato per tutta la durata dell'opzione e attualmente si applica solo ai contratti di locazione a scopo abitativo.

Questo tipo di tassazione si applica per l'intera durata del contratto di locazione, ma puĂČ essere revocata dal locatore.

Certificato energetico

L'attestato di prestazione energetica CasaClima Ăš un attestato di fabbisogno, cioĂš indica il fabbisogno di energia primaria e finale. Il fabbisogno energetico di un edificio Ăš determinato dalla qualitĂ  energetica dell'involucro edilizio e dei sistemi tecnici per il riscaldamento e la preparazione dell'acqua calda. Nel calcolo del fabbisogno energetico sono inclusi tutti i fattori rilevanti dal punto di vista energetico, come il volume e la superficie dell'edificio, il metodo di costruzione, il materiale di isolamento termico, il tipo di sistema per la produzione di acqua calda e il riscaldamento.

Catasto

Il catasto Ú un registro tenuto dalle autorità in cui sono registrati tutti gli immobili in Italia, organizzati per comune, con i relativi fogli di mappa, i numeri delle particelle e le unità immobiliari, nonché le altre informazioni necessarie per calcolare il valore unitario (valore catastale). Il valore unitario serve come base per il calcolo delle imposte. Questo registro ha una funzione puramente fiscale e non ha valore probatorio per quanto riguarda la proprietà, anche se i nomi dei proprietari sono registrati in esso.

Certificato di destinazione urbanistica

La designazione urbanistica, nota anche come certificato di zonizzazione, descrive come una proprietĂ  puĂČ essere utilizzata in base al piano di sviluppo o di utilizzo del territorio.

Classi catastali

La qualifica puĂČ essere utilizzata per determinare la categoria in cui rientra un immobile. Gli immobili ad uso residenziale o commerciale, ad esempio, sono categorie valide in tutta Italia.
All'interno di queste categorie ci sono diverse classi, cioĂš vengono fatte ulteriori distinzioni all'interno di una categoria in base ai possibili rendimenti di ciascun caso.

Attualmente esistono i seguenti sette gruppi:

Gruppo A - Immobili residenziali e uffici (Abitazioni e uffici)
Gruppo B - Immobili a destinazione terziaria (Immobili destinati a servizi)
Gruppo C - Immobili commerciali (Immobili commerciali)
Gruppo D - Immobili a destinazione speciale
Gruppo E - Immobili a destinazione particolare
Gruppo F - UnitĂ  immobiliari urbane (EntitĂ  urbane)
Gruppo T - Terreni (Terreni)

Contratto di compravendita

Un contratto di compravendita Ăš un accordo legale tra due parti, il venditore e l'acquirente, in cui il venditore si impegna a trasferire la proprietĂ  di un bene, ad esempio un immobile, all'acquirente e l'acquirente si impegna a pagare in cambio il prezzo di acquisto concordato.

Il contratto disciplina le condizioni della transazione, tra cui

  • IdentitĂ  delle parti contraenti (venditore e acquirente),
  • Descrizione dell'oggetto dell'acquisto,
  • Prezzo di acquisto e termini di pagamento,
  • Obblighi reciproci.

Nel caso di immobili, il contratto di compravendita deve essere redatto per iscritto e solitamente autenticato da un notaio. Il contratto di compravendita Ăš definito dall'art. 1470 del Codice Civile.

Contratto preliminare di acquisto

Il contratto preliminare Ú l'accordo scritto tra l'acquirente e il venditore in cui le parti contraenti si impegnano a concludere una transazione di acquisto e a concordare il prezzo di acquisto e le condizioni di pagamento, nonché le scadenze e le modalità fondamentali.

‍

Convenzione

Il termine "convenzione" significa che l'appartamento puĂČ essere occupato solo da persone in possesso dei requisiti richiesti. I requisiti sono almeno cinque anni di residenza nella provincia o di impiego nel comune in cui si trova l'abitazione. L'acquisto di tale immobile Ăš libero per chiunque, ai sensi dell'articolo 79 della Legge provinciale sulla pianificazione territoriale del 1997, ma deve essere occupato per uso personale o deve essere affittato a un "prezzo di affitto provinciale" calcolato come residenza primaria a una persona che soddisfi i criteri di cui sopra.

Cubatura

La cubatura urbanistica ù il volume fuori terra dell’edificio. Il volume edificabile da costruire su un lotto di terreno viene calcolato utilizzando l'indice di edificabilità specificato nel piano regolatore urbano applicabile per la zona edificabile in questione o dalle norme di attuazione della zona in questione.

Contratto

Un contratto Ăš un accordo legale tra due o piĂč parti in cui vengono stabiliti diritti e obblighi reciproci al fine di raggiungere un obiettivo legale e comune. In Italia, i contratti sono disciplinati dall'articolo 1321 del Codice Civile e devono soddisfare requisiti fondamentali quali il consenso, lo scopo, l'oggetto e, ove applicabile, i requisiti formali.

Capitolato descrittivo

‍Il capitolato descrittivo comprende un elenco dettagliato di tutte le caratteristiche relative alle dotazioni e alle finiture di un progetto edilizio. Contenuti importanti del capitolato sono, ad esempio, la struttura delle pareti e del tetto, il sistema di riscaldamento, il tipo di finestre, ecc. Inoltre, fornisce informazioni precise sui materiali utilizzati nella costruzione.

D
Deposito cauzionale (affitto)

Il deposito cauzionale Ăš una cauzione versata dall'inquilino al proprietario. Esso protegge il locatore nel caso in cui l'inquilino non adempia ai suoi obblighi di pagamento. Se, ad esempio, dopo il trasloco l'affitto mensile o i costi di gestione non sono ancora stati pagati o se l'inquilino non paga i danni all'appartamento, il locatore puĂČ trattenere il deposito. Il deposito cauzionale Ăš solitamente pari a 3 mesi di affitto.

‍

Donazione

Un dono Ăš un trasferimento gratuito di proprietĂ  o beni materiali da una parte a un'altra. In questo caso, solo il donatore fornisce un servizio che non richiede alcun corrispettivo. A seconda del valore e dell'importo, le donazioni possono essere tassate.

‍

Diritto di prelazione

Il diritto di prelazione si riferisce al diritto contrattuale o legale di una persona (avente diritto alla prelazione) di acquistare un terreno, un immobile o un appartamento alle stesse condizioni concordate tra un terzo e il venditore
Questo diritto sorge solitamente se il venditore ha concluso un contratto di acquisto con un terzo. La parte avente diritto alla prelazione viene informata e puĂČ decidere entro un certo periodo di tempo se stipulare il contratto d'acquisto al posto del terzo alle condizioni stabilite nel contratto.

‍

Diritto di abitazione

Il diritto di abitazione Ăš il diritto di occupare un immobile o una parte specifica di esso. Tuttavia, i costi di manutenzione e di gestione dell'immobile continuano a essere a carico del proprietario.

Il diritto di abitazione Ăš un diritto iscritto nel registro fondiario che conferisce a una persona il diritto permanente o temporaneo di utilizzare un immobile o una parte di esso senza esserne il proprietario. Permette all'avente diritto di vivere nell'immobile o di utilizzarlo per scopi residenziali, ma non di affittarlo a terzi.

Il diritto di abitazione puĂČ essere iscritto come diritto reale nel registro fondiario (ZGB art. 1022), il che significa che rimane in vigore anche se l'immobile viene venduto. Viene spesso concordato in occasione di donazioni o trasferimenti di proprietĂ  per garantire che il precedente proprietario rimanga nell'immobile.

EreditĂ 

L'ereditĂ  Ăš il patrimonio attivo e passivo di una persona che viene trasferito legalmente a uno o piĂč eredi dopo la sua morte. L'ereditĂ  puĂČ essere accettata o rinunciata entro sei settimane.

Finanziamento

Il finanziamento comprende tutti i processi necessari per un investimento precedentemente definito. CiĂČ include la richiesta, l'erogazione e il rimborso dei fondi messi a disposizione.

Fideiussione

La fideiussione nel contesto immobiliare Ăš un accordo contrattuale in cui una persona (garante) si impegna ad assumere le responsabilitĂ  di un'altra (debitore) nei confronti di un creditore se il debitore non adempie ai propri obblighi di pagamento. Nel settore immobiliare, la fideiussione Ăš spesso utilizzata per le locazioni o i finanziamenti edilizi, al fine di ridurre al minimo il rischio del creditore. Il garante si assume la responsabilitĂ  di saldare il debito se il debitore principale diventa insolvente.

Investimenti immobiliari

Gli immobili da investimento sono immobili che non vengono utilizzati dal proprietario e servono come investimento. Questi investimenti forniscono un reddito regolare attraverso la locazione. Possono essere immobili commerciali o residenziali.

‍

Imposta comunale GIS

L'imposta comunale sugli immobili viene pagata dai proprietari o dai titolari di diritti reali (usufrutto, diritti d'uso, diritti di abitazione, diritti di sopraelevazione) su edifici, terreni edificabili e terreni agricoli al Comune in cui si trova l'immobile. La base di calcolo Ăš il valore catastale. Il coefficiente con cui viene calcolata l'imposta puĂČ essere determinato dai comuni stessi, e le esenzioni per le residenze primarie possono anche essere derogate dal comune; queste vengono annullate nel caso di una residenza secondaria, nel qual caso l'imposta Ăš notevolmente piĂč alta.

Imposta sul valore aggiunto (IVA)

Ăš un'imposta da pagare sull'acquisto di un immobile se il venditore Ăš un promotore immobiliare o una societĂ  del settore. L'importo dell'imposta varia a seconda del tipo di immobile:

  • 4 % per l'acquisto di una residenza primaria,
  • 10 % per le seconde case,‍
  • 22% per gli immobili commerciali o gli appartamenti classificati come beni di lusso.

Imposte per l'acquisto

Quando si acquista un appartamento, l'acquirente deve pagare le seguenti tasse:

Al momento dell'acquisto della prima casa: Da un'impresa di costruzioni: 4 % di IVA + 600 euro
Da un privato: 2 % di imposta di registro + 100 euro

In caso di acquisto di una seconda casa:Da impresa di costruzioni: 10% di IVA + 600 euro
Da privato: 9% di imposta di registro + 100 euro

L'imposta di registro viene calcolata in base al valore catastale dell'appartamento e del garage.

Incarico

Un contratto di intermediazione Ăš un contratto tra un cliente (ad esempio, un proprietario) e un intermediario in cui quest'ultimo viene incaricato di intermediare un immobile, vendendolo o affittandolo. L'agente immobiliare riceve una commissione concordata in caso di successo dell'intermediazione.

Ipoteca

L'ipoteca dĂ  al creditore il diritto di ottenere la copertura di un immobile o di un bene mobile iscritto nel registro pubblico mediante asta pubblica, se il debitore non soddisfa il suo credito in tempo utile.

Esiste l'ipoteca legale (ad esempio a favore di un erede a garanzia di crediti), l'ipoteca giudiziale (a garanzia di un titolo di credito) o l'ipoteca volontaria (ad esempio per un prestito bancario, deve essere autenticata e iscritta nel registro fondiario).

L
Libro fondiario

Il registro fondiario Ăš un registro ufficiale e pubblico dei beni immobili in cui viene registrato l'assetto proprietario attraverso l'iscrizione dei relativi contratti (compravendita, donazione, permuta, ecc.), nonchĂ© i diritti associati alla proprietĂ  e i gravami su di essa (servitĂč, ipoteche, sequestri, pignoramenti, ecc.). Chiunque puĂČ consultare liberamente questo registro. Il catasto esiste solo in Alto Adige - cioĂš nella provincia autonoma di Bolzano e nella provincia di Trento, nonchĂ© nelle vecchie province austriache come Trieste e Gorizia-Gorizia e in alcuni comuni del Bellunese - ma non nel resto d'Italia. Il catasto tiene traccia principalmente dei proprietari e dei diritti attivi e passivi, nonchĂ© dei gravami, del catasto, delle dimensioni e delle variazioni di superficie delle proprietĂ .

M
Maso chiuso

Di norma, si tratta di proprietĂ  agricole con i relativi edifici agricoli. Il fattore giuridicamente decisivo Ăš l'iscrizione nella sezione I del registro fondiario. La legge sui masi costituisce il quadro giuridico per il mantenimento del maso chiuso come unitĂ  abitativa ed economica agricola, garantendo cosĂŹ la continuitĂ  dell'azienda agricola familiare. Un "maso chiuso" puĂČ essere venduto solo come unitĂ . La separazione o addirittura lo scioglimento di queste unitĂ  puĂČ essere autorizzata dalla commissione agricola locale o, in caso di ricorso, dalla commissione agricola provinciale. Secondo il censimento agricolo, in Alto Adige ci sono circa 20.200 aziende agricole, di cui circa 13.300 sono masi chiusi.

‍

Mandato in esclusiva

‍Un mandato in esclusiva Ăš un accordo tra un venditore di un immobile (committente) e un agente immobiliare, che conferisce all’agente il diritto esclusivo di commercializzare l’immobile e di reperire potenziali acquirenti o locatari. Durante la validitĂ  del mandato in esclusiva, il venditore non puĂČ incaricare altrgli agenti immobiliari.

Notaio

Il notaio Ăš un avvocato neutrale, nominato dallo Stato, che autentica le transazioni legali. Il notaio assicura che tutto sia legalmente corretto e comprensibile per le parti e garantisce l'affidabilitĂ  delle informazioni contenute nei registri pubblici, come il catasto.

‍

Nuda proprietĂ 

La nuda proprietĂ  si riferisce alla proprietĂ  di un oggetto senza il diritto di usarlo o di ricavarne un reddito. Significa che voi siete il proprietario legale, ma qualcun altro ha il diritto d'uso - di solito il diritto di usufrutto o usufruttuario.

P
Possesso

Il possesso descrive il controllo effettivo su una cosa, come ad esempio un immobile, indipendentemente dal fatto che la persona sia anche il proprietario legale. Il possessore utilizza o gestisce il bene senza necessariamente avere diritti di proprietĂ . Il possesso e la proprietĂ  possono essere separati, ad esempio nel caso di un affittuario che Ăš in possesso del bene ma non ne Ăš proprietario. Il possesso Ăš disciplinato dall'art. 1140 del Codice civile italiano.

‍

ProprietĂ 

Il diritto illimitato di una persona o di un'istituzione di disporre di un oggetto o di una proprietĂ , come ad esempio un immobile. La proprietĂ  comprende l'autorizzazione a utilizzare, affittare, vendere o gravare sulla proprietĂ  . Il proprietario Ăš registrato nel registro fondiario e puĂČ esercitare i suoi diritti in conformitĂ  alla legge. La proprietĂ  Ăš disciplinata dall'art. 832 del Codice civile italiano.

‍

Promotore edilizio

‍Il promotore edilizio ù un’impresa che di norma acquista terreni o edifici da demolire, li riprogetta, realizza nuove costruzioni chiavi in mano e li propone successivamente in vendita.

‍

Provvigione

La provvigione Ăš il compenso dell'agente immobiliare per la sua attivitĂ  di intermediazione. È dovuta al momento della stipula del contratto preliminare d'acquisto, che Ăš stato concluso grazie all'attivitĂ  dell'agente immobiliare. L'importo puĂČ essere concordato liberamente. La nostra commissione Ăš pari al 3% + IVA del valore della transazione. Per le locazioni, Ăš pari a un mese di affitto da entrambe le parti. Suggerimento fiscale: per un immobile registrato come residenza primaria, Ăš possibile detrarre dalle tasse il 19% della commissione dichiarata dall'agente immobiliare (massimo 1.000 euro).

R
Residenza primaria - residenza secondaria

Residenza primaria: si tratta dell'abitazione nel comune di residenza prescelto che viene utilizzata principalmente per vivere. All'acquisto di una residenza primaria si applicano diverse agevolazioni fiscali. Residenza secondaria: sono considerate residenze secondarie tutte le case e gli appartamenti per vacanze acquistati da un acquirente giĂ  proprietario di un'abitazione.

Rendimento

Il rendimento Ăš il profitto ottenuto da un investimento in percentuale del denaro investito. Mostra il rapporto tra i profitti e il capitale investito, solitamente in percentuale, e si basa sempre su un anno.

S
ServitĂč

‍Una servitĂč Ăš un diritto reale che conferisce al titolare il diritto di utilizzare in modo determinato un fondo altrui, ad esempio mediante un diritto di passaggio, un diritto di posa di condutture o un diritto di soprelevazione. La servitĂč grava sul fondo servente a favore del fondo dominante ed Ăš iscritta nel registro fondiario.

Superficie abitabile

La superficie abitabile indica l'area di un immobile che puĂČ essere utilizzata esclusivamente per vivere. Le terrazze e i balconi sono calcolati con determinati coefficienti.

‍

Superficie convenzionale

Si tratta della superficie abitativa legalmente riconosciuta dal sussidio abitativo. La superficie convenzionale Ăš cosĂŹ composta (calcolo secondo la Provincia Autonoma di BZ Alto Adige):

la superficie abitabile di un appartamento aumentata del 25%, il 25% della superficie dei balconi, il 50% delle superfici di logge o giardini d'inverno, il 30% delle superfici delle cantine, il 60% delle superfici dei garage, il 30% delle superfici dei posti auto scoperti, il 25% dei pergolati al piano terra, il 15% delle superfici delle terrazze, il 30% della superficie del sottotetto (con un'altezza minima di 1,5 m).

Superficie lorda

La superficie lorda dell'appartamento si riferisce alla superficie accessibile totale di un appartamento, compreso lo spessore dei muri esterni (spessore totale del muro) e la metĂ  dello spessore dei muri divisori tra gli appartamenti. Comprende quindi la superficie abitativa netta piĂč le superfici murarie.

Superficie calpestabile

Si tratta della superficie calpestabile di una casa o di un appartamento. La superficie abitabile effettiva si calcola a partire dalla porta d'ingresso, escludendo muri, balconi e terrazze.La superficie lorda di un appartamento indica l’intera area calpestabile, inclusi lo spessore completo delle pareti perimetrali esterne e la metĂ  dello spessore delle pareti divisorie tra gli appartamenti. Comprende quindi la superficie netta abitabile piĂč le superfici occupate dalle pareti.

Superficie commerciale

La superficie commerciale di un appartamento si calcola secondo i seguenti criteri: l'intera superficie abitativa, compresi tutti i muri, la metĂ  dei muri confinanti, la metĂ  dei balconi e della terrazza e un terzo della cantina.

‍

Spese per l'acquirente

L'acquirente paga tutte le spese di acquisto, le spese notarili, le spese di registrazione, l'iscrizione al registro fondiario e catastale.

Le spese per l'acquirente sono composte come segue:

  • Imposta di registro o imposta sul valore aggiunto
  • Imposta catastale e ipotecaria
  • Spese notarili
  • Commissione di intermediazione

Spese per il venditore

Le spese per il venditore possono variare a seconda dell’immobile e del periodo di detenzione. È quindi consigliabile consultare un esperto prima della vendita.

Stima

Per determinare il valore di un immobile si ricorre a una stima o una perizia. L'usufrutto Ăš il diritto personale piĂč completo di utilizzo di un immobile. Esso conferisce al titolare (usufruttuario) il diritto di utilizzare il bene nella sua interezza e di trarne i "frutti", come il reddito da locazione. Tuttavia, l'usufruttuario non Ăš il proprietario del bene, ma solo l'utilizzatore autorizzato.

L'usufrutto Ăš un diritto reale che viene iscritto nel registro fondiario e continua a esistere anche dopo la vendita dell'immobile. PuĂČ essere concesso per un periodo limitato o a vita. L'usufruttuario si fa carico dei costi e degli obblighi correnti dell'immobile (ad esempio, la manutenzione), mentre il proprietario rimane responsabile degli oneri di base (ad esempio, le ipoteche). L'usufrutto Ăš disciplinato dall'art. 987 del Codice civile.

Appraisal

An appraisal is used to determine the value of a property. We use various methods such as the comparative value method, the capitalized earnings value method, the asset value method or the DCF model. Not only real estate or land can be valued, but also usufructuary rights or bare ownership.

Building specification

A building specification comprises a detailed list of all the equipment and finishing features of a building project. Important contents of the building description are, for example, the condition of the walls and roof, the heating, the type of windows, etc. It also provides precise information about the materials used in construction.

Building plot

A building plot is a plot of land on which the owner has permission to build. The prerequisite for the construction of buildings is a building permit, which must be available for the property.

Broker

A broker is a person who professionally brings two or more parties together to conclude a transaction in accordance with Article 1754 and Article 1755 of the Italian Civil Code. Article 1755 stipulates that the broker is entitled to a commission from each party if the transaction has been concluded through his efforts. Article 6 of Law 39/1989 stipulates in this respect that only brokers registered in the Register of brokers are entitled to commission. In order to be registered in the register of brokers at the competent chamber of commerce, it is necessary to have a high school diploma, attend an intensive preparatory course and pass a rigorous written and oral examination before a panel appointed by the chamber of commerce.

Building volume

The urban building volume is the building volume above ground. The building volume to be built on a plot of land is calculated using the building index specified in the applicable urban land-use plan for the building zone in question or from the implementing regulations for the zone in question.

Brokerage instruction

A brokerage instruction is an agreement between a client, such as a property owner, and an estate agent, appointing the agent to arrange the sale or letting of a property. The agent receives an agreed commission when the transaction is successfully concluded.

Cedolare Secca

The Cedolare Secca is the so-called substitute tax on rental income, i.e. instead of Irpef income tax, the landlord pays a flat-rate tax of 21% on the annual rent for freely negotiated leases (10% on the annual rent for leases with an agreed rent in municipalities with a housing shortage).
Advantages: no registration and stamp duties; rent is not counted as part of total income
Disadvantages: the rent may not be increased for the duration of the option and currently only applies to rental agreements for residential purposes
This type of taxation applies for the entire term of the rental agreement, but can be revoked by the landlord.

Cadastre

The cadastre is a register maintained by the authorities in which all real estate properties in Italy are recorded. The entries are organized by municipality, and include the corresponding map sheets, parcel numbers, and building units, along with other information necessary for calculating the assessed unit value (cadastral value). The cadastral value serves as the basis for tax assessment. This register serves purely fiscal purposes and does not provide legal proof of ownership, even though the names of the property owners are listed in it.

Cadastral value

This is the tax value of a property, which is used to calculate taxes and duties.

Cadastral classes

The qualification can be used to determine which category a property falls into. For example, properties for residential or commercial use etc. are valid category designations throughout Italy.

Within these categories there are different classes, i.e. further distinctions are made within a category according to the possible returns in each case.

The following seven groups currently exist:

Group A - Residential real estate and offices (Abitazioni e uffici)
Group B - Real estate for service purposes (Immobili destinati a servizi)
Group C - Commercial real estate (Immobili commerciali)
Group D - Properties for special purposes (Immobili a destinazione speciale)
Group E - Properties for particular purposes (Immobili a destinazione particolare)
Group F - Urban real estate units (EntitĂ  urbane)
Group T - Land (Terreni)

Conventional area

This is the living space that is legally recognized by the housing subsidy. The conventional area is made up as follows (calculation according to the Autonomous Province of BZ South Tyrol):

the living area of an apartment increased by 25%, 25% of the balcony area, 50% of the areas of loggias or conservatories, 30% of the cellar areas, 60% of the areas of garages, 30% of the areas of open parking spaces, 25% of the pergolas on the first floor, 15% of the terrace areas, 30% of the attic area (at least 1.5 m high).

Convention

The term "convention" means that the apartment may only be occupied by persons who meet the requirements. The requirements are at least five years of residence in the province or employment in the municipality where the dwelling is located. The purchase of such a property is free to anyone, according to Article 79 of the Provincial Spatial Planning Act of 1997, but must be occupied as personal use or must be rented out at a calculated "provincial rent price" as a primary residence to someone who meets the above criteria

Commission

The commission is the real estate agent's remuneration for his brokerage activities. It is owed upon conclusion of the preliminary purchase agreement, which has come about through the broker's activity. The amount can be freely agreed. Our commission is 3% + VAT of the transaction value. For rentals, it is one month's rent from both parties. Tax tip: For a property that is registered as a primary residence, it is possible to deduct 19% of the declared broker's commission (max. €1,000) from tax.

Contract

A contract is a legal agreement between two or more parties in which mutual rights and obligations are established in order to achieve a legal and common goal. In Italy, contracts are regulated by the Civil Code Art. 1321 and must meet basic requirements such as consent, purpose, object and, where applicable, formal requirements.

Closed farm (maso chiuso)

A closed farm generally consists of agricultural land and its associated farm buildings. Its legal status depends on registration in section I of the land register. The law on closed farms provides the framework for preserving the holding as a single agricultural residential and economic unit, supporting the continuity of the family farm. A closed farm may only be sold as a whole. Division or dissolution requires approval from the local farms commission or, on appeal, the provincial farms commission. According to the agricultural census cited here, South Tyrol has approximately 20.200 agricultural holdings, of which about 13.300 are closed farms.

D
Donation

A gift is a gratuitous transfer of property or tangible assets from one party to another. In this case, only the donor provides a service that does not require any consideration. Depending on the value and amount, gifts may also be taxable.

Exclusive mandate

An exclusive mandate is an agreement between a real estate seller (client) and a real estate agent that grants the agent the exclusive right to market a property and acquire buyers or tenants for it. During the term of the exclusive mandate, the seller may not appoint another estate agent.

Easement

An easement is a right in rem that grants the beneficiary a specific right to use another person's property, such as a right of way, a pipeline right or a right of superstructure. The easement encumbers the servient property in favor of the dominant property and is entered in the land register.

Expenses for the buyer

The buyer pays all purchase costs, notary fees, registration fees, land register and cadastral entry.
The expenses for the buyer are composed as follows:

  • Register tax or value added tax
  • Cadastral and mortgage tax
  • Notary fees
  • Brokerage commission

‍

Expenses for the seller

The fees for the seller can vary depending on the property and the holding period. It is therefore advisable to consult an expert before selling.

Energy performance certificate

The ClimateHouse energy performance certificate is based on calculated energy demand and states both primary and final energy requirements. A building’s energy demand depends on the energy performance of its envelope and its heating and hot-water systems. The calculation takes into account all relevant factors, including the building’s volume and floor areas, construction method, insulation material, and the systems used to produce hot water and heat.

Financing

Financing includes all processes that are required for a previously defined investment. This includes applying for, providing and repaying the funds made available.

Gross area

The gross area of the apartment is the total accessible area of an apartment, including the thickness of the outer walls (full wall thickness) and half the thickness of the partition walls between the apartments. It therefore comprises the net living area plus the wall areas.

Guarantee

A surety in the real estate context is a contractual agreement in which one person (guarantor) undertakes to assume the liabilities of another (debtor) towards a creditor if the latter fails to meet its payment obligations. In the real estate sector, a surety is often used for tenancy agreements or construction financing in order to minimize the creditor's risk. The guarantor assumes responsibility for paying the debt if the principal debtor becomes insolvent.

Investment property

Investment properties are properties that are not used by the owner and serve as an investment. These investments provide a regular income through letting. These can be commercial or residential properties.

Inheritance

An inheritance is a person's assets and liabilities that are legally transferred to one or more heirs after their death. This inheritance can be accepted or waived within six weeks.

The Klimahaus is a building that has been constructed or renovated according to specific standards for energy efficiency, sustainability and environmental friendliness. It aims to minimize energy consumption and ensure a high level of living comfort. Certification is carried out by the ClimateHouse Agency system and comprises various categories such as ClimateHouse A, B or Gold.

Land register

The land register is an official public register of real estate. It records ownership through the relevant deeds, such as sales, gifts and exchanges, together with rights and encumbrances affecting a property, including easements, mortgages, attachments and seizures. Anyone may consult it. The land-register system described here operates in the autonomous provinces of Bolzano and Trento, in former Austrian territories such as Trieste and Gorizia, and in some municipalities in the Belluno area, rather than throughout Italy. It records owners, rights and encumbrances, cadastral references, property dimensions and changes in area.

Living area

The living area is the part of a property used exclusively for residential purposes. Terraces and balconies are included using specific weighting factors.

Municipal real estate tax Gis

The municipal property tax is paid by owners or holders of rights in rem (usufruct, right of use, right of residence, right of superstructure) to buildings, building plots and agricultural land to the municipality where the property is located. The basis for their calculation is the cadastral value. The coefficient with which the tax is calculated can be determined by the municipalities themselves, and allowances for primary residences can also be waived by the municipality; these are waived for secondary residences, in which case the tax is considerably higher.

Mortgage

The mortgage gives the creditor the right to obtain cover from a property or a movable item entered in the public register by public auction if the debtor does not meet his claim in good time.
There is the legal mortgage (e.g. in favor of an heir to secure claims), the judicial mortgage (to secure a debt title), or the voluntary mortgage (e.g. for a bank loan, must be notarized and entered in the land register).

Market value

The market value indicates the attainable price that can be achieved with the sale on the market. The value is determined by an appraiser or real estate expert.

Monument protection

Monument protection describes the preservation and maintenance of objects of art, history or nature in which there is a public interest. Properties that are listed must implement and comply with various requirements in order to preserve the building's originality.

Nuda proprietĂ  (bare ownership)

Bare ownership refers to ownership of an object without the right to use it or derive income from it. It means that you are the legal owner, but someone else has the right of use - usually the usufruct or usufructuary right.

Net living space

This is also referred to as pure living space and is the pure walkable area of a house or apartment. The effective living space is calculated from the front door, excluding walls, balconies and terraces.

Notary

The notary is a neutral, state-appointed lawyer who notarizes legal transactions. The notary ensures that everything is legally correct and understandable for the parties and guarantees the reliability of the information in public registers such as the land register.

Ownership

The unrestricted right of a person or institution to dispose of an object or property, such as real estate. Ownership includes the authority to use, rent, sell or encumber the property. The owner is entered in the land register and can exercise his rights in accordance with the statutory provisions. Ownership is regulated in Art. 832 of the Italian Civil Code.

Property developer

A property developer is a company that usually buys land or properties intended for demolition. These are then re-planned, developed ready for occupancy and offered for sale

Primary residence - secondary residence

Primary residence: This refers to the dwelling in the chosen municipality of residence that is primarily used for living. Various tax concessions apply to the purchase of a primary residence. Secondary residence: All holiday homes are considered to be secondary residences, as are those homes purchased by a buyer who already owns a home.

Purchase contract

A purchase agreement is a legal agreement between two parties, the seller and the buyer, in which the seller undertakes to transfer ownership of an item, e.g. a property, to the buyer and the buyer undertakes to pay the agreed purchase price in return.

The contract regulates the conditions of the transaction, including:

  • Identity of the contracting parties (seller and buyer),
  • Description of the object of purchase,
  • Purchase price and payment terms,
  • Mutual obligations.

In the case of real estate, the purchase contract must be drawn up in writing and usually certified by a notary. The purchase contract is defined in Art. 1470 of the Italian Civil Code.

Preliminary purchase agreement

A preliminary contract is a written agreement between the buyer and seller in which the contracting parties undertake to enter into a purchase transaction and agree the purchase price and the terms of payment and its basic deadlines and arrangements.

‍

Possession

Possession describes the actual control over a thing, such as a property, regardless of whether the person is also the legal owner. The possessor uses or manages the property without necessarily holding ownership rights. Possession and ownership may be separate, e.g. in the case of a tenant who is in possession of the property but does not own it. Possession is regulated in Art. 1140 of the Italian Civil Code.

Rental deposit

The rental deposit is a security deposit paid by the tenant to the landlord. It protects the landlord in the event that a tenant does not meet their payment obligations. If, for example, monthly rent or operating costs are still outstanding after the tenant moves out or the tenant does not pay for damage to the apartment, the landlord can retain the deposit. The rental deposit is usually 3 months' rent.

Right of first refusal

The right of first refusal refers to the contractual or statutory right of a person (pre-emptor) to purchase a plot of land, a property or an apartment on the same terms that a third party has agreed with the seller.

This right usually arises if the seller has concluded a purchase agreement with a third party. The party entitled to pre-emption is informed and can decide within a certain period of time whether to enter into the purchase agreement in place of the third party under the conditions stipulated in the agreement.

Right of residence

The right of residence is the right to occupy a property or a specified part of it. However, the maintenance costs for the upkeep and operation of the property continue to be borne by the owner.

A right of residence is a right entered in the land register that grants a person the permanent or temporary right to use a property or part of a property without that person being the owner. It allows the beneficiary to live in the property or use it for residential purposes, but not to rent it out to third parties.

The right of residence can be secured as a right in rem in the land register (ZGB Art. 1022), which means that it remains in place even if the property is sold. It is often agreed in connection with gifts or transfers of real estate in order to ensure that the previous owner remains in the property.

Return on investment

Return on investment expresses the profit from an investment as a percentage of the capital invested. It shows the relationship between profit and invested capital and is calculated on an annual basis.

Saleable area

The saleable area of an apartment is calculated using the following criteria: the entire living area including all walls, half of the adjoining walls, half of the balconies and terrace and one third of the cellar.

Taxes on the purchase of an apartment

When purchasing an apartment, the buyer must pay the following taxes:
When purchasing the first home:
From construction company: 4 % VAT + 600 euros
From a private individual: 2 % registration fee of the cadastral value+ 100 euros
When purchasing a second home:
From construction company: 10% VAT + 600 euros
From a private individual: 9% registration fee of the cadastral value + 100 euros

The registration fee is calculated on the basis of the cadastral value of the apartment and the garage.

Land-use zoning

The urban designation, also known as the zoning certificate, describes how a plot of land may be used according to the development or land-use plan.

Usufruct

The usufruct is the most comprehensive personal right to use a property. It entitles the holder (usufructuary) to use the property to its full extent and to draw the "fruits" from it, such as rental income. However, the usufructuary is not the owner of the property, but merely the beneficiary. The usufruct is a right in rem that is entered in the land register and continues to exist even after the property has been sold. It can be granted for a limited period or for life. The usufructuary bears the ongoing costs and obligations of the property (e.g. maintenance), while the owner remains responsible for basic encumbrances (e.g. mortgages). Usufruct is regulated in Art. 987 of the Civil Code

Value added tax (VAT)

VAT is a tax payable on the purchase of a property if the seller is a developer or a company in the real estate sector. The amount of the tax varies depending on the type of property:

  • 4 % for the purchase of a primary residence,
  • 10 % for second homes,‍
  • 22 % for commercial real estate or apartments classified as luxury goods.
